WHAT ARE THE PENALTIES AND DISQUALIFICATION PERIODS FOR A DRINK DRIVING CHARGE IN IPSWICH?

  • the maximum penalty is 14 penalty units ($1,929.90) or 3 months imprisonment.
  • the mandatory driver licence disqualification is 3 to 9 months from the date of conviction.

 

At or Over 0.05% BAC, but not over 0.10% BAC

For a first-time offender:

  • the maximum penalty is 14 penalty units ($1,929.90) or 3 months imprisonment.
  • the mandatory driver licence disqualification is 1 to 9 months from the date of conviction.

 

 

At or Over 0.10% BAC, but not over 0.15% BAC

For a first-time offender:

  • the maximum penalty is  20 penalty units ($2,757.00) or 6 months imprisonment.
  • the mandatory driver licence disqualification is 3 to 12 months from the date of conviction.

 

At or Over 0.15% BAC

For a first-time offender:

  • the maximum penalty is  28 penalty units ($3,859.80) or 9 months imprisonment.
  • the mandatory driver licence disqualification is 6 months from the date of conviction.

 

PLEASE NOTE in certain circumstances the maximum penalties and disqualification periods will increase.

 

COULD YOU HAVE A DEFENCE? 

 

There are 4 basic defences potentially open to persons charged with drink driving:

 

  1. The breath, saliva or blood specimen police took from you was taken more than three hours after you had driven the vehicle, been in charge of the vehicle or attempted to put in motion the vehicle.

 

  1. You were not driving the vehicle.

 

  1. You did not attempt to put the vehicle in motion.

 

  1. You were not in charge of the vehicle.
